Faskh is dissolution by an adjudication decision where valid grounds are established. It is considered through Islamic Sharia principles and the relevant jurisprudence.
Potentially Relevant Grounds
Grounds may include harm, abuse, abandonment, neglect, non-contact or failure of marital responsibilities. Whether a ground is established is a matter for the adjudication process and scholars, not the website.
Evidence and Response
Evidence may include statements, correspondence, testimony, official documents and patterns of conduct. The other party is notified and given an opportunity to respond in writing. A lack of response does not necessarily prevent the process from continuing.
Outcome
Where valid grounds are established, the husband’s consent is not required. The religious outcome is an irrevocable separation (baynunah).
Published fee: the current starting total is £1,100, comprising a £900 starting fee and £200 casework credit. The initial review confirms whether Faskh is the appropriate route.
